You warrant that you have the right to provide such materials and that their use will not infringe third-party rights.
Confidentiality
Each party agrees to keep confidential all non-public information disclosed by the other party in connection with an Engagement or preliminary discussions. Confidential information does not include information that is publicly available, independently developed, or lawfully obtained from a third party without restriction.
Confidentiality obligations survive termination of an Engagement for a period of five years, except for trade secrets and personal data which remain protected for as long as legally required. Disclosure may be made where required by law, regulation, or citst order, provided reasonable notice is given where permitted.
Limitation of Liability
To the fullest extent permitted by law, GARICHA LIMITED shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunity, arising from use of the GARICHA LIMITED additionallybsite or Services.
Our aggregate liability arising from any Engagement or use of the GARICHA LIMITED additionallybsite shall not exceed the fees paid by you to GARICHA LIMITED in the twelve months preceding the event giving rise to the claim, except where liability cannot be limited by law including death or personal injury caused by negligence or fraud.
Data Protection
GARICHA LIMITED processes personal data in accordance with UK data protection legislation. GARICHA LIMITED additionally act as data controller for website visitor data and as data processor where we handle personal data on yits behalf during service delivery. Our Privacy Policy describes categories of data, purposes, legal bases, retention, and yits rights.
Where we process personal data as processor, we implement appropriate technical and organisational measures and assist you in fulfilling data subject requests where contractually required. International transfers are conducted with appropriate safeguards such as standard contractual clauses where applicable.
Service Delivery Standards
GARICHA LIMITED applies a mooring standard to service delivery: receive the arrival, read conditions, assign the berth, secure the line, handle the work, clear the outcome, and keep the berth ready. Timelines, milestones, and acceptance criteria are defined in each Engagement document.
